Yasharth is a counsel at Singularity Legal. He holds an LL.M. in International Dispute Settlement and Arbitration from Leiden University, The Hague (2021-2022). He specialises in advising energy & resources, construction & infrastructure companies and institutional investors in shareholder and joint venture disputes, and operational disputes. His range of experience includes advising clients in international arbitrations under various rules and in cross-border disputes before courts in India and United Arab Emirates. He also represents athletes and sports federations in anti-doping and other sports disputes. He has previously worked in various legal roles in India and in the Netherlands.
Arbitration
- Representing an Indian trading company in a dispute against a Hong Kong-based trader. (SIAC Rules, English Law)
- Representing a Singapore-based pharmaceutical company in an arbitration under a shareholders' agreement against their Indian joint venture partners (India seated, Indian law)
- Representing a petrochemical project management company in their dispute against a global construction engineering conglomerate arising out of non-payment of success fee under two consultancy agreements for provision of contractual, claims and commercial consultancy services in relation to one of the largest oil facilities projects.
- Advising a Turkish global steel and trading company in its dispute arising out of non-performance and breach of contract to supply agricultural commodities with an Indian Trading company (ICC Rules Geneva)
- Advising a UAE based trading company engaged in ready-made metal products in its dispute arising out of non-payment of dues under a sale of goods contract with a Senegalese based metal and mining company (Swiss Rules of International Arbitration of SCC, Swiss Law).
- Represented a leading oil & gas exploration and production company in a contractual dispute with construction company for construction project of its head office. (India seated, Indian laws)
- Represented a leading oil & gas exploration and production company in an EPC contractual dispute (India Seated, Indian Laws)
Litigation
- Representing a multi-national consumer products conglomerate in enforcement proceedings instituted before Dubai Courts arising out of an Iraqi Court judgment involving questions surrounding procedural and substantive violations to the Riyadh Convention.
- Representing a power weightlifter who was tested and charged for doping by National Anti-Doping Agency. (Delhi High Court)
- Representing personal guarantors before the Hon’ble Supreme Court of India in batch petitions challenging provisions of Insolvency and Bankruptcy Code, 2016.
- Represented a leading oil & gas exploration and production company challenging a multi-million dollar final award before the Delhi High Court.
- Represented a major port trust before the Hon’ble Supreme Court of India against a consortium of companies led by a Singaporean company in relation to dispute regarding existence of arbitration agreement.
- Represented a South Korean Bank in Insolvency & Bankruptcy proceedings against a government owned entity before National Company Law Appellate Tribunal.
Authored a paper titled “Standing at Crossroads: The Trajectory of IIAs and ISDS and Their Projection in the Post-Pandemic Global Economy” published in vol. 22 issue 2 pp.409 of the Pepperdine Dispute Resolution Law Journal (2022).
